South Dakota Social Media Recordkeeping Guide.

Understanding what the South Dakota Public Records and Files law requires of your social media activity, and what "compliant" actually looks like in practice, isn't always straightforward. This plain-language guide gives counties, cities & municipalities and public agencies a clear path.

SDCL §§ 1-27-35 to 1-27-38 — South Dakota's process starts with an informal request. If that request is denied or goes unanswered in whole or in part, a formal written request to the public record officer must be answered within 10 business days: provide the record, deny the request, or acknowledge receipt with an estimate of the time reasonably required to respond. No response within 10 business days is deemed a denial (SDCL § 1-27-37).
